1. Acceptance of Terms

By accessing, browsing, or using the BlazeRush Arcade website located at blazerusharcade.com (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), together with our Privacy Policy and Cookie Policy, which are incorporated herein by reference. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and BlazeRush Arcade ("we," "us," or "our"). If you do not agree to all of these Terms, you must not access or use our Platform. Your continued use of blazerusharcade.com following the posting of any changes to these Terms constitutes your acceptance of those changes. We reserve the right to suspend or terminate your account at our sole discretion if we believe your account has been compromised or if you have violated any provision of these Terms. BlazeRush Arcade uses the localStorage prefix "rush_" to store your preferences, gameplay progress, and session data locally on your device. This data is stored only on your browser and is not transmitted to our servers unless explicitly described in our Privacy Policy. You may clear this data at any time through your browser settings.

4. Prohibited Conduct

When using BlazeRush Arcade, you agree not to engage in any of the following prohibited activities: using the Platform for any unlawful purpose or in violation of any applicable Canadian federal, provincial, or local law or regulation; attempting to gain unauthorized access to our systems, servers, networks, or other users' accounts through hacking, password mining, or any other means; interfering with or disrupting the integrity or performance of the Platform, including by transmitting viruses, worms, malware, or any other malicious code; using automated scripts, bots, crawlers, or scraping tools to access, collect, or index content from the Platform without our express written permission; impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity; harassing, threatening, intimidating, or bullying other users of the Platform through community features or any other means; posting, uploading, or transmitting content that is defamatory, obscene, offensive, hateful, discriminatory, or otherwise objectionable; attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code of any software or technology used on the Platform; and using the Platform in any manner that could damage, disable, overburden, or impair our servers or networks.

5. Intellectual Property

All content, features, and functionality on blazerusharcade.com, including but not limited to text, graphics, logos, icons, images, audio clips, video content, interactive modules, game designs, software, and the compilation thereof, are the exclusive property of BlazeRush Arcade or its licensors and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The BlazeRush Arcade name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BlazeRush Arcade. You must not use such marks without our prior written permission. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial entertainment purposes, subject to compliance with these Terms. This license does not include the right to modify, reproduce, distribute, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from our Platform except as incidental to normal web browsing and as permitted by these Terms.

6. User Content

BlazeRush Arcade may allow you to submit, post, or share content through community features, forums, or feedback mechanisms ("User Content"). You retain ownership of any intellectual property rights that you hold in your User Content. However, by submitting User Content to our Platform, you grant BlazeRush Arcade a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with operating and providing the Platform and our services. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to submit your User Content and to grant the foregoing license. You further represent that your User Content does not violate any third party's intellectual property rights, privacy rights, publicity rights, or any applicable law. We reserve the right to remove any User Content at our sole discretion without notice if we believe it violates these Terms or is otherwise objectionable.

7. Disclaimers

BlazeRush Arcade is provided on an "as is" and "as available" basis without any warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable Canadian law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, reliability, or timeliness of any content available on the Platform. BlazeRush Arcade is a free social entertainment platform that provides interactive digital experiences for recreational purposes only. No content on our Platform should be interpreted as offering financial advice, financial services, or any form of monetary transaction. All arcade experiences, including Cash Vandal Street Run, are purely for entertainment purposes and involve no financial risk, no monetary exchange, and no tangible prizes of monetary value.

8. Limitation of Liability

To the maximum extent permitted by applicable Canadian law, in no event shall BlazeRush Arcade, its directors, officers, employees, agents, partners, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Platform; any conduct or content of any third party on the Platform; any content obtained from the Platform; or unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. Our total aggregate liability for all claims arising out of or relating to these Terms or your use of the Platform shall not exceed one hundred Canadian dollars (CAD $100.00). This limitation of liability applies to the fullest extent permitted by law in the applicable jurisdiction within Canada.

9. Indemnification

You agree to defend, indemnify, and hold harmless BlazeRush Arcade, its directors, officers, employees, agents, partners, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorney's fees) arising from or related to your use of the Platform; your violation of these Terms; your violation of any third party's rights, including intellectual property rights, privacy rights, or publicity rights; your User Content; or any breach of your representations and warranties set forth in these Terms. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any matter without the prior written consent of BlazeRush Arcade.

10. Governing Law

These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be instituted exclusively in the courts of the Province of Ontario, located in the City of Toronto, and you irrevocably submit to the jurisdiction of such courts. You agree to waive any objection to the exercise of jurisdiction over you by such courts and to the venue of such courts. Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or other proprietary rights. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.

11. Modifications

BlazeRush Arcade reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time, including the availability of any feature, content, or interactive module, without prior notice. We may also revise these Terms at any time by posting an updated version on this page. The "Last updated" date at the top of these Terms indicates when the most recent revisions were made. Material changes will be communicated through a prominent notice on our Platform or by email to registered users. Your continued use of the Platform after any such changes constitutes your binding acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform and, if applicable, deactivate your account. It is your responsibility to check this page periodically for changes.
